There is no specific crime of teen sexting in Virginia. Instead, a teenager would be charged with a state or federal child pornography offense. Under Virginia Code 18.2-374.1:1, it is a crime to be in the possession of or to distribute child pornography. This includes creating, possessing, sending, or resending sexually explicit pictures of minors under 18 years old through text messages. There is no distinction between adults and juveniles under this law.
It is also a crime if an adult (or much older teen) asks someone underage to pose for sexual pictures, or to take part in sexual acts via webcam or smartphone. This is called online child sexual abuse.
Juvenile sexting is increasing in frequency.1 A recent study found that 20 percent of teenagers (22 percent of girls and 18 percent of boys) sent naked or seminude images of themselves or posted them online.2 Another survey indicated that nearly one in six teens between the ages of 12 and 17 who own cell phones have received naked or nearly nude pictures via text message from someone they know.3
